Terms and Conditions

These Terms & Conditions govern your use of The Godfathers Of Deep House SA platform, including public browsing, accounts, music and media access, memberships, GF Nostalgear purchases, bookings, and all related features made available through the website.

1. Who We Are

The platform is operated for The Godfathers Of Deep House SA through The Godfada Recording Label (Pty) Ltd and related business structures connected to the brand. References to we, our, or us mean the operator of the platform and brand services unless the context requires otherwise.

2. Acceptance of Terms

By accessing or using the platform, you agree to these terms, our Privacy Policy, Cookie Policy, Return Policy, Shipping & Delivery Policy, Acceptable Use Policy, and any additional rules that apply to specific features. If you do not agree, do not use the platform.

3. Eligibility and Accounts

You must provide accurate information, keep your login details secure, and use the account only for lawful purposes. User registration is available for customer access. Artist access is governed separately and may be invite-only or otherwise restricted. We may suspend or limit access where we reasonably believe an account is compromised, used unlawfully, or used in breach of these terms.

4. Platform Features

The platform may include music releases, radio, GFTV, product sales, exclusive access, memberships, bookings, contact forms, and secure account environments. Features may change over time. We may add, remove, pause, or modify features where operationally necessary.

5. Product and Media Information

We aim to present descriptions, artwork, pricing, and availability accurately, but some information may change or may appear differently on different devices. Artwork, previews, colors, and design presentation are illustrative and may vary from the final physical product or final mastered media. Release and product availability may be limited by rights, territory, stock, or timing.

6. Orders, Payments, and Currency

Orders are subject to acceptance, availability, and payment confirmation. The platform may show prices in a regional display currency while settlement is processed in the configured settlement currency. You are responsible for any charges, taxes, duties, bank fees, or foreign-exchange effects applied by your provider or by law. We may reject or cancel orders affected by fraud signals, pricing errors, stock errors, or unlawful use.

7. Digital Access and Memberships

Music, video, subscriptions, memberships, and other digital entitlements may be delivered immediately or shortly after successful payment. Access rights are personal to the permitted account holder unless we expressly state otherwise. You may not resell, transfer, share credentials for, or bypass controlled access layers without written permission.

8. Bookings

A booking request is an enquiry, not a confirmed performance contract. Any confirmed booking remains subject to availability, negotiation, pricing, travel, hospitality, security, and other agreed terms. The public booking form helps start the process, but the final engagement only exists once the relevant parties confirm it through the proper booking channel.

9. Intellectual Property

All music, videos, artwork, text, branding, code, layout, logos, trademarks, and related content on the platform are owned by us or licensed to us unless stated otherwise. Your use of the platform does not transfer ownership. You may not copy, scrape, reproduce, distribute, publicly display, reverse engineer, or commercially exploit platform content except as allowed by law or by our written permission.

10. User Content and Communications

If you submit a review, message, booking request, contact form, or other content, you must have the right to submit it and it must not be unlawful, defamatory, misleading, abusive, or infringing. We may remove content, restrict access, or report activity where reasonably necessary to protect the platform, other users, artists, or our legal position.

11. Prohibited Conduct

You may not misuse the platform, including by scraping, probing private endpoints, attempting to access restricted areas, bypassing paid access, sharing credentials, uploading malicious material, interfering with media delivery, using bots without permission, submitting fraudulent orders or bookings, or violating any applicable law. 12. Third-Party Services

The platform may integrate with payment providers, hosting services, logistics providers, media platforms, or similar third parties. Your use of those third-party systems may also be subject to their own terms and policies. We are not responsible for third-party systems beyond our own legal responsibilities.

13. Suspension and Termination

We may refuse, suspend, or terminate access where we reasonably believe a user has breached these terms, created security risk, abused payments or access rights, or exposed the platform or others to harm. We may also retain relevant records where needed for compliance, dispute resolution, or legal defense.

14. Disclaimers and Service Availability

The platform is provided on an as-available basis. We aim for stable operation but do not promise uninterrupted access or that every release, stream, preview, order flow, or feature will always be available without interruption, latency, or maintenance.

15. Liability

Nothing in these terms excludes liability where the law does not allow exclusion. Subject to mandatory law, we are not liable for indirect, incidental, consequential, or special loss arising from use of the platform, including loss of profits, loss of business, or loss caused by third-party systems, connectivity failure, or unsupported user devices. Your statutory consumer rights remain unaffected.

16. Governing Law and Consumer Protections

These terms are governed by the laws of South Africa, unless mandatory consumer law in your place of residence provides protections that cannot be waived. If you are an international consumer, any non-excludable rights available to you under applicable law continue to apply in addition to these terms.

17. Changes

We may update these terms from time to time. The updated version applies once posted, except where law requires a different process. Continued use of the platform after the update means you accept the revised terms.
